General terms and conditions below shall apply to sales by ROCK STAR CONSTRUCT SRL (Hereinafter referred to as "Seller" or "RockStar") through the online store / website PIATRAONLINE.com
to the Buyer, a person or legal entity, as the case (hereinafter "Purchaser"), the goods displayed on the Seller's website and providing related services provided by the Seller (eg. Services delivery). Goods subject to trade through this website will be referred to as "goods".
Through the contract of distance sale (ticking "I read the Terms and Conditions PIATRAONLINE" before ordering or paying it) between Buyer Seller, Buyer expressly agrees the terms and conditions below and undertakes to compliance them.
Using, accessing or browsing this website by visitors and users implies accepting the terms and conditions set forth below.
II. Description of the goods / products
All descriptions, specifications, advertisements, images (both printed and those on the Seller's website) and samples sent by courier or delivered in the Seller's showroom are presented for information purposes and are intended to give a approximate representation of products. They can not be considered standard 100% since the products to be supplied are made of natural stone and variations in color, texture, markings, size of lots of stone or other like this are normal about these products, variations not being controlled directly by the Seller or its suppliers.
Taking into consideration the type of products (natural stone) The Buyer expressly declares that he has been accepted as follows:
a. all descriptions, images (both print and on the internet) and samples sent by courier or delivered in the Seller's showroom can provide only a rough representation of products;
b. because products are natural, geological variations exist between groups in terms of color, markings, texture, size;
c. all types of natural stone are porous to some extent and must be waterproofed according to its own type;
d. Some goods may scratch or chip easily so attention must be paid to handling and transport of natural stone;
e. the percentage of flaws or cracks in a command can be between 1 and 5%, which is determined from the amount delivered without the Seller being obliged to pay damages or compensation and without having any obligation to return or paying any amounts by Buyer. If the above mentioned percentage is exceeded, Seller undertakes to replace broken or damaged products that exceed the rate of 1-5%, if the damage is attributable to the Seller.
Prices are based on current cost of products sold without VAT. VAT is added at the time of writing the order on Seller's website, under the legislation in force at the date of order.
No product has a delivery cost included. Product delivery to the address indicated by the Buyer will make payment costs, plus VAT.
Seller reserves the right to change prices displayed on the website, without being obliged to give prior notice of their intent to change. However, Seller shall not alter in any situation the active orders and prices that were charged in advance from Buyer.
If the price of products ordered but have not been charged an advance from the Buyer, Seller shall send a notice will inform the Buyer, which will be able to withdraw by sending a notice to the Seller within 48 hours from receiving notification about the price change.
For specific, atypical / templated parts it will be charged an additional fee of 40% of the cost of the order sent by the client (by atypical / templated parts it is understood a piece that does not have the shape of a square or rectangular, which is different ot f the order what usually Seller is introduced in an excel table as date that go in the Workshop to be cut).
The price of the ordered product is the one displayed at the date the order is confirmed by the Seller and is valid for 24 hours from notification. To maintain the validity of the reservation, the Byer agrees to pay the advance within the validity period mentioned above. Otherwise the booking will be canceled and the product will return in stock, available for sale. The price communicated at the time of order confirmation will include all applicable taxes, and the fee of transport services, where transport is requested by the Seller. The cost of transportation is mentioned separately per order / invoice.
Orders are always paid in full before delivery / lifting frm showroom / warehouse.
For products that are not in Seller's stock and subject to special order (delivery) he Buyer shall pay an advance of 40% of order price when placing the order and the remaining price will be paid by the Buyer to the Seller at least two (2) days before the date announced for delivery.
Payment by the Buyer to the Seller's bank account will be considered valid only after receiving the corresponding amounts in the account Seller.
B. Availability of goods / products
If the goods are in stock in our warehouse, then they will be released from the deposit for delivery within 2 working days, excluding the order day. The delivery of products depends on the delivery method selected by Buyer.
If the products are not in Seller's stock for any reason, Seller shall notify the Purchaser on this and advise on an anticipated date on which products will be available for delivery.
Seller shall not be liable and will not owe any damages or compensation in cases Buyer's products are not available to be delivered at the time of placing the order by the Buyer.
II. Technical steps to conclude the contract

A. Selecting a product
To add the product to your shopping cart, click on "add to cart"
After adding a product to the cart, the Buyer will be redirected to the shopping cart, where he/she can update the quantity of products added to the cart or remove products from the shopping cart. He/she can complete the order from the basket or can return to the store to continue shopping.
Delivery cost value is added automatically to the order value. The cost of product transportion depending on the delivery method chosen by the Buyer, and the city of destination.
B. Placing the order
If you already have account in the online shop of the Seller, the Buyer can log in with your email address and password to use delivery and billing information existed into the account.

E. Chosing the payment method
Depending on the method of delivery, RockStar offers the following payment methods:
- Cash on delivery
- Online by www.euplatesc.ro
- Bank payment order
Seller will issue, based on information held by it and those provided by the Buyer an invoice for goods delivered.
After the buyer has chosen method of delivery, payment and expressed consent by checking "I agree with the terms of the contract at a distance and use techniques of distance communication", click "send order" and the order will start being processed. After submitting the order, the Buyer will receive an email confirmation from the Seller on receiving the order. Then the Seller will send an email confirmation processing order issued by the Client.
Once the order is launched online, Buyer agrees with the form of subsequent communication (phone or electronically) as well as the operation methods of the Seller. Any order confirmed by the Seller impliers the Buyer and Seller in a distance contract.
The moment of concluding the remote contract with an individual, respectively concluding the contract of sale with a legal person, is considered the moment the confirmation message is received from the Seller.
III. The opening hours. Delivery.
Orders can be placed online 24 hours per day 7 days per week, but their processing time is from Monday to Friday between 9-18. Orders placed on Saturdays, Sundays and holidays will be processed the next working day.
The opening hours are 9 to 18 from Monday to Friday and Saturdays from 10.00 to 15.00 (GMT +02:00 Europe)
A. Duration of delivery
Goods ordered, if possible, will be released from the warehouse for delivery normally within 2 working days, excluding the day the order has been made and will be sent only to the address specified by the Buyer. The delivery duration of goods depends on the delivery address indicated, weather conditions and other factors and will be communicated by Seller to Buyer. Delivery will take place normally from Monday to Friday between 9.00 and 18.00 (GMT +02:00 Europe).
Any data that are fixed for the delivery of goods are approximate and Seller shall not be responsible for any delay, regardless of what caused this. Goods can be delivered by Seller prior to the date fixed for delivery, by undertaking prior notice to Buyer
If Seller is unable, for whatever reason, to send the goods ordered by the Buyer (and in stock) within 14 days from placing the order, the Buyer has the right to cancel the order and Seller shall reimburse any amount of money paid by the Buyer for these products. Seller shall not be responsible for any losses incurred by the Buyer for deliveries delayed or for being unable to perform delivery for reasons related to the Buyer.
If the buyer or his representative is not indicated for the delivery address, making it impossible to handing over the goods by delivery personnel, return costs will be paid by the Buyer to the Seller within 5 days of the invoice related.
If the Buyer shall make a request to return the deliver of goods, the Buyer will be obliged to pay the Seller a new transportation cost before the delivery.
The buyer is legally late on the obligation regarding the taking the goods in the periods specified below, these being calculated as follows:
maximum 7 to 10 days for goods on stock at the date of cashing the order; and

If, for any reason attributable to the Buyer, delivery does not take place due date, the Buyer agrees to pay the Seller 0.5% of the total order, per day of delay by way of penalty contract.
B. Program. Technical conditions
All deliveries are made using heavy vehicles, starting from 1 ton. The buyer is solely responsible for the ability to bring products on his property at the moment of deliverance.
Seller is obliged to deliver by charge, as the case, buyer is obliged to raise the goods under the conditions establihed when placing the order. Prices of transport are determined by destination, quantity, tonnage and specifications of Buyer and they are communicated to him/her when transmitting the related pro forma invoice when submitting the order, depending on the coordinates indicated by the Buyer when ordering.
Deliveries are made from Monday to Friday, between 9 and 18. The buyer may specify a preferred delivery date, in case of longer periods than indicated by the Seller, and Seller will adjust the delivery depending on Buyer's program at no extra cost. However, the products are delivered or raised at a maximum of 5 days from the moment of informing the fact that goods are available in stock to be delivered or raised.
Buyer shall inform Seller at the time of indicating the delivery place if there are any access restrictions or difficulties a transportarion vehicle may face. The buyer is obligated at the delivery address to ensure the presence of a representative to sign documents related to the delivery and reception and to oversee unloading. The goods are delivered to buyer costs, but by means of the Seller to the address indicated by the Buyer. The price for the transmission service is established and highlighted separately and bears VAT. If the indicated location features do not allow the downloading the products and standing freight cars, Seller shall not be liable and will not be responsible to Buyer for any damages or compensations for non-delivery of goods in time or denial of delivery.
In these cases, Buyer shall make available to the delivery staff the nearest accessible point of discharge and otherwise, Buyer agrees to pay the Seller the equivalent round-trip transportation and costs of a subsequent supply, using other means of transport that can fit in that location.
Delivery staff is not obligated to handle the goods delivered.
C. Conduct of reception
The goods are received at loading in case of raising the order in the showroom and at unloading place for delivery at the address specified by Buyer.
At the delivery time, the technical conditions of the goods delivered are checked, and the parties will sign, through either authorized representatives or through their representatives, the invoice and packing list for goods delivery without any objections, if the technical condition of the delivered products is considered satisfactory.
If there are products damaged / missing, this will be recorded directly on Packing List section for mentions and buyer will not accept the downloading of the damaged products without prior noticing this to Seller by phone and sending pictures via email. Seller undertakes to replace / substitute products damaged / missing within 5 days from the date of finding, if the products are in stock or not subject to special orders. Any subsequent complaint will not be accepted. Any defect, inconsistency, lack is found in loading / receiption of the goods and subsequent complaints will not be accepted. Seller shall not be liable and will not owe any damages or compensation in cases the products are deteriorated as a result of any operations Buyer has in unloading during the delivery of products.
The customer can choose to raise the order in person or through a representative directly from Seller's premises 137A Teisani Street, Bucharesr, with prior notice and only with a vehicle that can be loaded with a forklift / equipment for loading and unloading.
The percentage of goods that can have minor flaws / cracks or scratches is between 1 and maximum 5% of the quantity delivered.
IV. The promotions are valid:
- For limited time periods specified on the presentation of products from the online store;
- Within the limits of available stocks.
RockStar can not be held responsible for damages caused by information published in the online shop by error or on partner websites.
RockStar reserves the right to complete and / or modify any information from the online shop without notice to users of the site.
RockStar reserves the right to contact the visitor of virtual store by email or phone if after interaction with the site the visitor fill the identification and contact forms and expressly requests any type of information available.
Buyer will not disclose to third parties, by any means, any information of a private nature sent from Seller, under penalty of coercing the Buyer to pay damages.
Seller reserves the right to use information provided by Buyer in order to achieve the contract. Buyer also will not make public any third party any information regarding the order without the written consent of the Seller.
Seller reserves the right, based on prior consent of the user, to store and use in its own interest any information provided by Buyer through PIATRAONLINE
site, in order Seller to achieve marketing activities, information, billing or other thigs like these.
Seller will not also provide any third party information received from Buyer, excepting the agreed service providers that signed a contract by which they are obliged to protect the data received from Buyer.
When using Seller's website, the user / Buyer will provide the Seller personal information that will be used only in order to complete the order, for delivery, in case of any questions that may arise and to inform Buyer about any special offers or new product ranges.
VI. The property transfer
The transfer of ownership of the products will operate at the date of cashing their price by Seller and transfer risks it will operate at the actual delivery date to Buyer.
VII. Exercising the right of withdrawal. Acceptance of goods and return policy.
Buyer refuses delivered goods if they do not comply with the technical details specified in the order. In this case Seller takes responsibility to bring products into compliance.
Buyer individual has the right to notify Seller waive the purchase without penalty and without giving any reason within 14 calendar days of receiving the product, contractual provisions applicable only to buyers individuals and may return the product (s) in the same within 14 days. Buyer will have to bear the additional cost of returning the goods in case of withdrawal. The additional costs represent all costs (transport, delivery, diminishing the value of products resulting from manipulations other than those necessary to establish the nature qualities and operating products, postage or any other kind) which are to be supported by the consumer when exercising the right of withdrawal.
The return of products is made within 14 days from delivery of products, based on the form of return that you can access here, and Form return to be considered may be sent no later than in the 14th calendar day from the date of delivery of the product.
Refund must be made within 14 calendar days of reception of goods in the RockStar warehouse in the bank account obligatorily indicated by Buyer in the Return Form.
Depending on the method of delivery chosen by Buyer, the amount refunded will be equal to the amount resulted by Seller withholding from the price paid by Buyer the transportation and delivery costs. The refunding of the amounts collected, if buyer does not want another product, will be made by bank transfer into the account indicated in writing on Form Return by Buyer.
Products can not be returned in case of:
- Exceeding the period of 14 calendar days from reception
- They are part of Special items from our Steps / Sills / Countertops Range;
- they meet the technical specifications mentioned in the order;
- they were the subject of a special order;
- they were the subject of a final liquidation of stock, after which the buyer benefited from a reduction in price;
- They were purchased from the showroom and although it showed some flaws, Buyer has accepted and benefited from a corresponding reduction in price;
- They have been clearly personalized to Buyer demand;
- They have been executed after Buyer's specifications;
- They show signs of impact or damage;
- They show visible signs of wear;
Products will necessarily be returned in original packaging (packaging that were purchased), with all accessories and initial label intact (no traces of use, damage, impact), the products are undamaged, unused, shows no adhesive residue or other such substances. These are returned in the packaging unit (package, box, bag, box, etc.), and will be accompanied by all the accessories that were delivered and the invoice and / or receipt of purchase tax

The full return of consideration paid will be done only if the products are in proper condition. If the product has been used by the Buyer and can not be returned in proper condition, ROCK STAR CONSTRUCT SRL it will not refund the money.
VIII. Major force
Neither of parties will not be liable to the other for failure to enforce the obligations arising from this Agreement, in the event that such failure was caused by force majeure.
In the event of an intervention force majeure, stakeholders rely owes it to take all measures reasonably necessary to remove the consequences of force majeure and occurrence of force majeure notify the other Party within 5 days. Violation of these duties remove the effects of the force majeure on the Agreement, the guilty parties remain obligated to answer for its failure.
If the effects of the force majeure lasts longer than 90 days, either party has the option of unilateral termination of the Contract, with no penalty to either party.
IX. Litigation. Applicable law
Any disputes arising between Buyer and Rock Star Construct SRL will be settled amicably.
If this is not possible, the settlement will return to the competent courts in Bucharest, Romania.

X. Guarantee compliance
For products sold by Seller to Buyer, as individual, a legal compliance 2 year guarantee is granted according to GEO 34/2014.
All products are under guarantee according Law 449/2003. Conditions of granting the guarantee vary from case to case, for individuals, and for legal persons. In this respect, the guarantee will be granted differently, under special legislation regarding guarantees of products, respectively, under the Civil Code.
To qualify for the warranty, Buyer should have the original receipt and the original invoice on him/her.

XI. INFORMATION NOTE ON PERSONAL DATA PROTECTION
